These General Terms and Conditions (GTC) of KPM Königliche Porzellan-Manufaktur Berlin GmbH (KPM) govern the customer's free participation in our WEISS Customer Club program. Upon conclusion of the customer club contract at www.kpm-berlin.com/pages/kpm-weiss-club, the customer shall receive a customer card with the designation KPM Customer Club WEISS on the basis of these GTC. A customer within the meaning of these GTC is the holder of a KPM Customer Club WEISS card. Any natural person who has reached the age of 18 may participate. KPM remains the owner of the KPM Customer Club WEISS Card.
Customer card contract
The customer is obliged to fill out the application documents completely and correctly and to sign them in person. If the application documents are completed online, verification is carried out via e-mail address. The submission of the application constitutes the customer's offer to KPM to conclude the customer club contract. The customer card contract is concluded when KPM issues the KPM Customer Club Card WHITE to the customer. Only the principal cardholder (hereinafter: cardholder) is entitled to the customer club contract. The KPM Customer Club Card WHITE is not transferable to third parties. Customer card account: Upon conclusion of the customer club card contract, KPM shall set up a customer card account for the cardholder. The financial year of the customer card contract begins on 01.01. and ends on 31.12. of the year. In addition to the necessary personal data, the customer card account stores the cardholder's purchases made using the KPM customer club card in the current financial year and the current status of the bonus in compliance with data protection regulations.
Advantages of the customer club
An annual bonus amounting to 3% of the annual turnover (applies exclusively to porcelain and merchandise, not to services); advance announcements when new products are introduced; price advantages and exclusive articles; free delivery from an order total of 250 euros in the KPM online store and the KPM Stores. Sales within the meaning of the customer club card account are exclusively purchases made and paid for in full by presenting the KPM customer club card and entering the customer card number. A "retrospective" or "retroactive" presentation of the customer card is not possible. The turnover recorded on the customer club card account is not transferable to third parties and is due exclusively to the cardholder. Sales generated through the purchase of gift vouchers and the purchase of already reduced items from the KPM range are excluded from the customer club card program. In the event of a legally permissible or agreed reversal (contract cancellation, rescission, withdrawal, exchange, etc.) of a purchase, as well as in the event of incorrect bookings or misuse, KPM has the right to debit the cardholder's customer club account accordingly and to reverse bookings.
Redeeming the bonus
The bonus earned in the course of a financial year (01.01.-31.12.) is sent to the cardholder in the form of a KPM credit card. It can only be redeemed by the cardholder in the following financial year with the subsequent purchase(s) of goods by presenting the KPM credit card at the checkout or in the online store. Cash payment of the KPM credit card is not possible. Only the holder of the main card is entitled to the bonus.
Card loss / card misuse
If you discover that your card has been lost or misused, please notify KPM Customer Club WEISS Customer Service immediately (address below). Card misuse is deemed to have occurred in particular if the card is not used in accordance with the contract. KPM shall only be liable for damages resulting from a culpably omitted or delayed notification in the event of intent or gross negligence. KPM shall block the customer club card if KPM becomes aware of the loss or misuse of the card.
Use of your data
By registering for the KPM Customer Club WEISS, we process and store the customer data for the calculation of the annual bonus, for advertising addressed to the customer by post and for market research purposes. The use of the data for these purposes can be objected to at any time by post or e-mail.
Newsletter
When registering for the KPM Berlin newsletter, the customer receives an e-mail immediately after registration in which the newsletter registration must be confirmed (double opt-in). The customer's IP address, date and time are stored for data protection purposes when the newsletter is confirmed. The data is used exclusively for sending the KPM newsletter and is not passed on to third parties. Exceptions to this are technical service providers who send the newsletter. The customer can unsubscribe from the KPM newsletter at any time by clicking on the unsubscribe link in the newsletter or by sending an e-mail to weisskundenclub@kpm-berlin.com.
Cancellation of the card contract
The holder may cancel the customer club card at any time by means of a declaration in text form. The declaration must be addressed to KPM Berlin GmbH Kundenclub WEISS, contact details below. The declaration of termination is equivalent to the return of the customer card to KPM Kundenclub WEISS. Upon termination of the customer card, the card also loses its validity. The termination does not affect the bonus, which must be redeemed within three months of receipt of the customer's notice of termination. After expiry of this period, the bonus expires. KPM is entitled to terminate the customer card contract with a notice period of three months to the end of a financial year by means of a declaration in text form to the customer. A bonus must be redeemed by the customer by the end of the financial year in which the termination takes effect. Thereafter, the premium expires. The right to terminate the contract without notice for good cause remains reserved. If the contract is terminated and KPM is responsible for the good cause for termination without notice, the provisions on ordinary termination, redemption and forfeiture of the bonus shall apply. If KPM terminates the customer card contract for good cause, the bonus shall expire at the end of the financial year in which the termination was declared by KPM in text form.
